Family’s Son Kidnapped by Police for Traveling With Marijuana from a Legal State to Alabama

In the United States, recreational use of cannabis is legalized in 19 states and the District of Columbia while another 13 states have decriminalized its use. In other states like Alabama, however, cops still viciously seek out those who would dare possess and ingest a plant that has never killed anyone. Now, because tyrant drug warriors are still addicted to kidnapping, caging, and killing people over this plant, a couple — who lives in a legal marijuana state — had their child stolen from them for traveling to the non-legal state of Alabama.

In March, Erika Prock left her home in Michigan to drive to Alabama and pick up her husband from his family’s home. She had her 18-month old son with her for the trip. After grabbing her husband, Todd Prock, the two began their journey back to Hillsdale, Michigan but would never make it.

While stopped for lunch, a “hero” officer claimed to smell weed on Todd Prock’s breath and used this as probable cause to search the couple’s car. The Procks, who live in a recreationally legal state had marijuana in their trunk which set off a series of events akin to a scene out of 1930s Germany.

Though Todd Brock admitted that he smoked marijuana, Erika was completely sober and had been for over two years as she is a recovering addict. Nevertheless, police kidnapped their son and put him into foster care where he remains today.

“They just ripped him away from me,” she said. “It was like he was being kidnapped.”

As she sat in the back of the squad car while police kidnapped her son and handed him off to a social worker, Prock tried alerting the social worker to her son’s medical conditions. As she explained his conditions and begged the social worker to call her mother, the kidnapping cops had enough and rolled up the window.

“That’s the first thing that’s in my head,” Prock said. “What if he goes there and they don’t know and he’s sleeping and stops breathing and dies? I mean, horrible thoughts go through my head because of what we have been through. I have a little bit of PTSD from it.”

The couple was subsequently charged with felony chemical endangerment — a law used to target parents who run meth labs with children near them. According to the law, a person commits the felony if he or she “knowingly, recklessly, or intentionally causes or permits a child to be exposed to, to ingest or inhale, or to have contact with a controlled substance, chemical substance, or drug paraphernalia.”

No one ever, including children, in the history of the world, has ever been harmed from being near, touching, or otherwise smelling the cannabis plant. Despite these facts, the drug warrior state of Alabama has placed the couple’s child in foster care as they seek to lock up the couple for years. In fact, this law has been used to tear children away from multiple families in the state who have been caught with this plant — a disgusting travesty indeed.

Had the couple been in Michigan, this would have been a non-issue.

“If we could have taken our situation and transported it to Michigan, we would have been on our way,” Erika Prock said. “None of this would have happened. Nothing. Like absolutely nothing.”

The state of Alabama is not sympathetic.

“Although an officer may exercise discretion,” Lawrence County District Attorney Errek Jett, whose office is handling the case, told AL.com, “there is no provision under the laws of Alabama to permit possession of marijuana if the individual is from a state where it is lawful.”

For now, the Procks are living in a tent behind Erik’s family’s home, fighting to get back their child.

“I am a recovering addict and I just want to do something about this,” Prock said. “Because what if this happens to somebody else and they’re a recovering addict and they’re not strong enough to stay clean. And they end up relapsing, or even worse, dying or overdosing and then a child is without a mother because Alabama is so just overkilling with that charge and taking children.”

Hopefully, this couple gets their baby boy back soon as other couples who have had their children taken over marijuana have experienced living nightmares. Alexandria Hill, a 2-year-old little girl, was taken from her father because he used marijuana to treat his seizures. Her father, Joshua Hill told a case worker with Child Protective Services that he would smoke marijuana after little Alexandria would go to sleep at night to treat his medical condition.

The state immediately kidnapped Alexandria and placed her in foster care to “protect” her from her father using a plant to treat his seizures. While under the state’s “protection” she would be brutally murdered less than six months later.
